Terms of Service for Circuit IQ

1. Agreement to Terms
Welcome to Circuit IQ! These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Fab Soft (part of Fab Works LTD) (“we,” “us,” or “our”), concerning your access to and use of the Circuit IQ web application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”).
By using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, then you are expressly prohibited from using the service and you must discontinue use immediately.
2. User Accounts
To use most features of the Service, you must register for an account. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
3. User-Generated Content
You are solely responsible for the content you create and upload to the Service, including workout names, notes, and images ("User Content"). You retain full ownership of your User Content. However, by posting User Content, you grant us a license to use, display, and distribute it as part of providing the Service to you and other users.
You agree not to create or upload any User Content that is unlawful, offensive, defamatory, or otherwise objectionable. We reserve the right, in our sole discretion, to remove any User Content that violates these Terms without prior notice.
4. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:
- Attempt to impersonate another user or person.
- Use any information obtained from the Service in order to harass, abuse, or harm another person.
- Attempt to bypass any measures of the Service designed to prevent or restrict access.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Use the Service as part of any effort to compete with us or otherwise use the Service for any revenue-generating endeavor.
5. Subscriptions and Payment (For Future Pro Tier)
Some parts of the Service may be billed on a subscription basis. We will use a third-party payment processor (Stripe) to bill you through a payment account linked to your account. All payments shall be in Pound Sterling (GBP). You agree to our pricing and payment terms as we may update them from time to time. We reserve the right to correct any errors or mistakes in pricing.
6. Disclaimers & Limitation of Liability
The Service is provided on an as-is and as-available basis. You agree that your use of the Service is at your sole risk. You are solely responsible for your own health and safety. Circuit IQ provides fitness information and is not a medical organization. We are not responsible for any injuries you may sustain as a result of using the Service. You should consult with your physician before beginning any new fitness program.
7. Termination
We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time, including for any violation of these Terms. You may terminate your account at any time by contacting us or using the in-app account deletion feature if available.
8. Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
